Failure to provide, or a delay in providing, the required notice or documentation may result in a denial of the request or a delay in the approval of the request. Payment You will be paid for all paid safe and sick leave time at the regular hourly rate that you would have earned had you not taken paid safe and sick leave. Time taken as paid safe and sick leave will not count as hours worked towards your overtime eligibility. No payments will be made in lieu of unused paid safe and sick leave, either at the end of the calendar year, upon separation from employment, or at any other time. Return-From-Leave and Job Protections Upon returning from leave, you will be restored to the position you held prior to taking leave with the same pay and other terms and conditions of employment. The Firm is prohibited from discharging, threatening, penalizing, or in any other manner discriminating or retaliating against an employee who has exercised their rights under the law. Separation from Employment & Reinstatement Upon Re-Hire If you are an employee in the NY office and are rehired within six months of separation, any accrued, unused sick leave not paid out at the time of separation will be reinstated upon rehire.
