Benefits after the Elimination Period but before Claim Approval If your elimination period has been satisfied and you have properly submitted your short-term disability claim, but your claim has not yet been approved or denied, you must use available accrued sick or PTO leave to maintain income benefits, except if you are an employee in DC or CA where you can elect to use either paid or unpaid leave. Once your disability claim is approved, sick or PTO leave used to cover this time may be recovered. If you have exhausted all of your sick and PTO leave, you will be placed in an unpaid leave status. If your claim is denied, you may not recover sick or PTO leave used while waiting for a claim determination. Benefit If you have worked for the Firm for less than 5 years, you will receive 70% of your weekly earnings. If you have worked for the Firm for more than 5 years, you will receive 90% of your weekly earnings. Senior staff will receive 100% of their weekly earnings. Coordination of Benefits with Other Plans Benefits under this plan will be reduced by any benefits you receive through workers’ compensation. This may require you to repay a portion or all of the short-term disability benefits you receive from Venable.
