Using Paid Safe and Sick Leave Beginning on January 1, 2021, employees are entitled to begin using their accrued paid safe and sick leave by making an oral or written request. An employee may take up to the maximum number of days of paid safe and sick leave that the employee is eligible to accrue that year on the first day of the calendar year. In other words, you need not wait until you have fully accrued the paid safe and sick leave time in order to be able to use it. For the first year of employment, paid safe and sick leave is prorated according to the number of days worked during the year. Carry over of Paid safe and sick leave If you do not use all of your accrued paid safe and sick leave days by the end of a calendar year, the unused days will be carried over into the following calendar year, and not cashed out. At any point in time, an employee may have no more than 20 days of accumulated unused sick leave. No additional paid safe and sick leave (up to the maximum accrual of 8 days) may be earned (accrued) until employee’s paid safe and sick leave is below the 20 day maximum. Paid safe and sick leave amounts are set January 1 st of each year and are in effect for the full year. No adjustments of paid safe and sick leave accruals will be made at any time during the year if a part-time employee works more or less hours than their schedule.
