A Civil Air Patrol member who returns to work following their Civil Air Patrol leave will be entitled to: - the seniority and benefits the member had on the date their leave began; - any additional seniority and benefits the member would have attained at the Firm if he or she had remained continuously employed.

A Civil Air Patrol member who returns to work following their Civil Air Patrol leave may not be terminated by the Firm for a period of one (1) year after returning to work, except for cause.

The Civil Air Patrol member may not be reinstated if the Firm’s circumstances have so changed as to make employment impossible or unreasonable; employment would impose an undue hardship on the Firm; the position from which the member takes leave is for a brief non-recurring period and there is no reasonable expectation that such employment will continue indefinitely or for a significant period; or the Firm had sufficient cause legally to terminate the member at the time he or she commenced such leave.
