o Staff members with three months to less than five years of service are eligible to receive an employee benefit of 70% of your weekly earnings. o Staff members with five years or more of service are eligible to receive an employee benefit of 90% of your weekly earnings. The above paid leave weeks will be designated as FMLA leave and counted toward your 12 work-week entitlement. You will then be required to substitute accrued (or earned) paid leave as appropriate before being eligible for unpaid leave for what remains of the 12-week entitlement. B. Eligibility To qualify for the above listed benefits you must meet all of the following conditions which are also necessary for family or medical leave eligibility: 1. You must have worked for the Firm for 12 months or 52 weeks. The 12 months or 52 weeks need not have been consecutive. Separate periods of employment will be counted, provided that the break in service does not exceed seven years. For eligibility purposes, an employee will be considered to have been employed for an entire week even if you were on the payroll for only part of a week or if you were on leave during the week. 2. You must have worked at least 1,250 hours during the 12-month period immediately preceding the commencement of the leave. The 1,250 hours do not include time spent on paid or unpaid leave.
